Italian citizenship is given and attributed through ius sanguinis:
This means that its passed on from one generation to the other through Italian descendants.
In other words, you don’t have to be born in the territory of Italy to acquire the citizenship.
The most important factor is to establish that when a descendant is born , one of the parents is an Italian citizen.
Let me give you an example:
Let’s say that your parents were born in Italy, then they moved to another country, They had children, the children’s can be Italian citizen if at their birth one of the parents
maintained their Italian citizenship.
In other words if your parents immigrated in 1970, and you were born in 1975, at this date you have to prove that one of your parents were still Italian in 1975.
If this is the case you are an Italian by descent, and are able to apply for the Italian citizenship.
If you get married and have children, they too have the right to apply for the Italian citizenship.

Regulatory Information
In accordance with current legislation, which requires knowledge of the Italian language, information regarding citizenship by marriage is provided in Italian.
Those seeking Italian citizenship through marriage or civil union must be aware of their duties to the Italian Republic, first and foremost adherence to national values and irreproachable conduct.
The acquisition of Italian citizenship by a foreign or stateless spouse who married an Italian citizen after April 27, 1983, is currently regulated by Law No. 91 of February 5, 1992 (Articles 5, 6, 7, and 8) and subsequent amendments.
Applications for Italian citizenship can also be submitted by foreign citizens who have entered into a civil union with an Italian citizen, registered in the civil status registers of the Italian municipality (Legislative Decrees 5, 6 and 7/2017).
A foreign spouse/civil union partner can acquire Italian citizenship upon application, subject to the requirements established by current legislation, as explained in the following sections.

Requirements for applying for citizenship
Residence in the consular district :
The applicant must submit the application to the diplomatic-consular representation competent for his or her residence, exclusively through the appropriate IT application (see below: Point 4, Procedure, Phase 1 – Registration and Entry of Application).
The spouse/partner in the civil union who is an Italian national must be a resident and duly registered with the Registry of Italians Residing Abroad (AIRE) in the relevant consular district, and live at the same address as the applicant for citizenship. Otherwise, both spouses must provide documentation proving the reason (e.g., work, children's education, medical care, or other) that determines or has determined the need for separate domicile.
Submission Terms :
The application can be submitted three years after the marriage/civil union is celebrated, if the spouse is an Italian citizen by right of blood, that is, from birth. If the spouse acquired Italian citizenship after the marriage (e.g., by residency in Italy), the three years begin from the spouse's naturalization date. The three years are reduced to one and a half years if the spouses have children born or adopted.
Transcription and validity of marriage/civil union :
If it occurred abroad, it must have been previously transcribed at a Municipality in Italy.
The marriage/civil union relationship must remain valid and stable until the adoption of the citizenship granting decree. In order to be granted Italian citizenship, the marriage/civil union must not have been dissolved by separation or divorce as of the date the decree is adopted. However, the death of the spouse after the citizenship application has been submitted does not result in the forfeiture of the benefit.
Criminal situation :
Absence of convictions by Italian judicial authorities for crimes carrying a penalty of more than three years in prison.
Absence of convictions by foreign judicial authorities of a sentence exceeding one year for non-political crimes.
Absence of convictions for crimes against the personality of the State and of reasons impeding the security of the Republic.
Knowledge of the Italian language no lower than level B1 of the Common European Framework of Reference (CEFR)
Payment of taxes and fees indicated in the Documents and Costs sections
Documents required for citizenship application
Original birth certificate or equivalent, issued no more than six months ago by the country of birth, complete with all personal details (including paternity and maternity), duly legalized/apostilled, and translated into Italian.

The document must be legalized with an apostille . For apostilles on documents issued in the province of Quebec, please contact the Ministry of Justice of Quebec . To obtain an apostille on documents issued in the provinces of New Brunswick, Prince Edward Island, Nova Scotia, Newfoundland and Labrador, and the Autonomous Territory of Nunavut, please contact Global Affairs Canada . Birth certificates issued in Canada can be translated by a certified translator whose signature must be legalized by our Consulate General (a list is available at this link ).
If the document was issued elsewhere, you should contact the Italian Embassy or Consulate responsible for the country where the document was issued. Translations of certificates issued by other countries can be certified as compliant by the Consulate responsible for the country of issue or recognized with an Apostille .
Original criminal records from your country of origin, any third-party countries of residence (starting at age 14) – except Italy – and any countries of citizenship, issued no more than six months prior to submitting the application, duly legalized/apostilled, and translated into Italian.
The applicant is exempt from presenting a criminal record from their country of origin only if they left their country of origin before turning 14 and have not retained their citizenship.
A criminal record certificate with photo and fingerprints is required for Canada . To request a criminal record certificate in Canada, please visit this website and contact your local police station. The translation of criminal records issued in Canada can be done by a certified translator whose signature must be legalized by our Consulate General (a list is available at this link ).
For criminal records from other countries, please contact the embassy or consular office responsible for the country where the document was issued. Translations of certificates issued by other countries may be certified as compliant by the consulate responsible for the country of issue or recognized with an apostille .
Receipt of payment of the €250 contribution to the Ministry of the Interior and the €16 stamp duty, as indicated in the "Costs" section.
Identity document : photocopy of your passport or valid foreign identity card (pages with personal information, photograph, issue and expiry dates).
A copy of the marriage certificate or summary extract from the marriage register , to be requested from the competent Italian municipality where the certificate is registered, preferably issued no more than six months ago.
PLEASE NOTE : If the applicant is an EU citizen, he/she may use the self-certification pursuant to Presidential Decree 445/2000.

Other certifications from the aforementioned bodies or other institutions are not suitable and cannot be accepted.
However, the following are not required to present a certificate of knowledge of the Italian language:
Foreigners (even those residing abroad) who have signed the Integration Agreement pursuant to Article 4-bis of Legislative Decree No. 286/1998 (Consolidated Immigration Act).
Holders of a long-term EU (or EC) residence permit as per Article 9 of the same Consolidated Law (even if residing abroad), only if issued by the Italian authorities. Residence permits for family reasons or those issued by other countries are not eligible.
Those who have obtained a qualification issued by a public or private educational institution recognized by the Ministry of Education, University and Research and/or the Ministry of Foreign Affairs and International Cooperation.
Procedure
PHASE 1 – REGISTRATION AND APPLICATION SUBMITTAL
Applicants residing abroad must register on the Ministry of the Interior portal ( https://portaleservizi.dlci.interno.it/AliCittadinanza/ali/home.htm ) without using SPID but with their email address.
Please note that the email address provided on the portal when submitting the online application constitutes your domicile (Article 47 of the Italian Civil Code). Therefore, it is essential to check your email inbox frequently, as all communications relating to your citizenship application, including requests for additional documentation, summonses, notifications of measures, etc., will be sent exclusively electronically.
The applicant is required to register their data with the utmost care, as they cannot be modified. If an error is made, they will need to register again with a different email address. Specifically, the personal information indicated on the birth certificate (including any annotations) and/or on documents issued abroad by the competent foreign authorities (such as marriage certificates, identity documents, name/surname change orders, etc.) must be included. In the event of discrepancies, the applicant is required to provide appropriate supporting documentation.
The application must state whether the applicant has any minor children from a previous relationship living with him/her.
All residences from the fourteenth year must be declared and no periods of time must be left undeclared.
No special characters or symbols should be included (for example, the cedilla, acute or grave accents within the word, circumflex accents, etc.). Only the accent on the last letter can be used, using an apostrophe if one is also present in the original language.
PHASE 2 – CONSULAR VERIFICATION
The Consular Office will be automatically notified of the application submission and will proceed with the necessary checks. The applicant will then receive, electronically via the Ministry of the Interior portal, notification regarding the acceptance or rejection of their application.
If your application is rejected, you can resubmit it, taking care to correct any errors indicated in the rejection. Any payments already made can be reused if you resubmit the application within one year.
If accepted, the applicant will be summoned electronically to the diplomatic-consular representation to authenticate the signature on the citizenship application, to submit all original paper documentation, including that already submitted electronically via the Portal, and to collect the applicable consular fees.
All the above documentation will be retained in original by the diplomatic-consular representation, with the exception of the identity document and the language certificate, for which a certified copy will be made with the relevant payments.
PHASE 3 – EVALUATION AND TERMS OF THE PROCEDURE
The Ministry of the Interior is solely responsible for evaluating the application and finalizing the procedure, within 24 months of the application submission date, extendable up to a maximum of 36 months. If the application is successfully evaluated, the Ministry of the Interior will send the decree granting Italian citizenship to the diplomatic-consular mission responsible for the applicant's residence.
PHASE 4 – DECREE, NOTIFICATION AND OATH
The decree granting Italian citizenship will be notified to the applicant via the portal. Upon notification, documents verifying the permanence of the marital bond, dated after the decree, will also be requested, such as (non-exhaustive list):
Complete marriage certificate issued by the competent Italian municipality (not the extract) and corresponding foreign document
Criminal record certificate from the country of current residence, duly legalized and translated (see "Documents" section)
Therefore, as of the date of adoption of the decree, the marriage or civil union must not have been dissolved, nor must there have been a legal separation (separation decree). However, the death of the spouse after the citizenship application has been submitted does not result in the forfeiture of the benefit.
No later than six months after notification, the interested party will be summoned to the consular offices to swear an oath of allegiance to the Republic and its laws. The six-month deadline is mandatory, after which the right to citizenship will be lost.
Payment of the stamp duty on the decree is required.
The full marriage certificate must be requested from the Italian municipality where the certificate is registered; the criminal record certificate must be requested from the competent authorities in the country of residence and must comply with the regulations regarding legalization/apostille and translation, as explained in the "Documents" section.
The interested party will swear an oath of allegiance to the Italian Republic by pronouncing the following words:
“I SWEAR TO BE FAITHFUL TO THE REPUBLIC AND TO OBSERVE THE CONSTITUTION AND THE LAWS OF THE STATE”
The acquisition of Italian citizenship will take effect from the day following the oath.
The original birth certificate will be sent for transcription to the relevant Italian municipality along with the AIRE registration request and the official statement of the oath.
Costs
A €250 contribution to the Ministry of the Interior, payable exclusively via PagoPa when completing the application or by bank transfer to the bank account indicated by the Ministry of the Interior (receipt to be included in the online application), with any costs to be borne by the person instructing the transfer.

Citizenship by marriage or civil union
1. Cenni normativi
In conformità alla normativa in vigore, che richiede la conoscenza della lingua italiana, le informazioni relative alla cittadinanza per matrimonio vengono fornite in italiano.
Coloro che richiedono la cittadinanza italiana per matrimonio o unione civile devono essere a conoscenza dei doveri nei confronti della Repubblica italiana, primi fra tutti l’adesione ai valori nazionali e l’irreprensibilità della condotta.
L’acquisto della cittadinanza italiana da parte del coniuge straniero o apolide che abbia contratto matrimonio con cittadino italiano a partire dal 27 aprile 1983 è attualmente regolato dalla Legge 5 febbraio 1992 n. 91 (artt. 5, 6, 7 e 8) e successive modifiche.
Le richieste di cittadinanza italiana possono essere presentate anche da parte del cittadino o della cittadina stranieri che hanno costituito un’unione civile con cittadino/a italiano/a trascritta nei registri dello stato civile del Comune italiano (D. Lgs. 5, 6 e 7/ 2017).
Il coniuge/parte dell’unione civile straniero può acquistare la cittadinanza italiana su domanda, in presenza dei requisiti stabiliti dalla normativa vigente, come spiegato nelle sezioni successive.

2. Requisiti per la richiesta della cittadinanza
Residenza nella circoscrizione consolare:
Il richiedente dovrà indirizzare la domanda alla Rappresentanza diplomatico-consolare competente per la sua residenza, esclusivamente attraverso l’apposito applicativo informatico (vedi oltre: Punto 4, Procedura, Fase 1 – Registrazione e inserimento istanza).
Il coniuge/parte dell’unione civile di nazionalità italiana deve essere residente e regolarmente iscritto all’Anagrafe degli Italiani residenti all’estero (A.I.R.E.) della circoscrizione consolare di competenza e convivente allo stesso indirizzo del richiedente la cittadinanza. In caso contrario, dovrà essere fornita da entrambi i coniugi documentazione comprovante la motivazione (es. lavoro, scolarità dei figli, cure mediche o altro), che determina o ha determinato la necessità del domicilio disgiunto.
Termini di presentazione:
la domanda può essere presentata tre anni dopo la celebrazione del matrimonio/unione civile, se il coniuge è cittadino italiano iure sanguinis, cioè dalla nascita. Se il coniuge italiano ha acquisito la cittadinanza successivamente al matrimonio (ad es. per residenza in Italia), i tre anni decorrono dalla data della naturalizzazione del coniuge. I tre anni vengono ridotti a un anno e mezzo in presenza di figli nati o adottati dai coniugi.
Trascrizione e validità del matrimonio/unione civile:
Se avvenuto all’estero, deve essere stato precedentemente trascritto presso un Comune in Italia.
Il vincolo di coniugio/unione civile deve rimanere valido e stabile fino all’adozione del provvedimento di concessione della cittadinanza. Al fine del conferimento della cittadinanza italiana, alla data di adozione del decreto non deve essere intervenuto lo scioglimento del matrimonio/unione civile per separazione personale o divorzio. Invece, il decesso del coniuge dopo la presentazione della domanda di cittadinanza non comporta la decadenza dal beneficio.
Situazione penale:
Assenza di sentenze di condanna da parte delle Autorità giudiziarie italiane per reati per i quali sia prevista una pena superiore a tre anni di reclusione.
Assenza di sentenze di condanna da parte delle Autorità giudiziarie straniere ad una pena superiore ad un anno per reati non politici.
Assenza di condanne per delitti contro la personalità dello Stato e di motivi ostativi per la sicurezza della Repubblica.
Conoscenza della lingua italiana non inferiore a livello B1 del Quadro Comune Europeo di Riferimento (QCER)

3. Documenti necessari per la richiesta di cittadinanza
Estratto dell’atto di nascita o equivalente, in originale, rilasciato possibilmente da non oltre sei mesi dal Paese in cui si è nati, completo di tutte le generalità (incluse paternità e maternità), debitamente legalizzato/apostillato e tradotto in lingua italiana.
Per l’esatta dicitura dell’atto richiesto e l’ente di rilascio si rimanda a: Nascita – Consolato Generale d’Italia di Montreal (esteri.it). L’atto dovrà essere legalizzato tramite apostille. Per quanto concerne l’apposizione dell’apostille sui documenti emessi nella provincia del Québec si prega di fare riferimento al Ministère de la Justice du Québec. Per far apporre l’apostille su documenti emessi dalle province di Nuovo Brunswick, Isola del Principe Edoardo, Nuova Scozia, Terranova e Labrador e Territorio Autonomo di Nunavut, si prega di far riferimento a Global Affairs Canada. La traduzione dei certificati di nascita formati in Canada può essere effettuata da un traduttore o traduttrice certificato/a la cui firma dovrà essere legalizzata dal nostro Consolato Generale (un elenco è disponibile a questo link).
Se l’atto è stato formato altrove, occorre prendere contatto con l’Ambasciata o il Consolato d’Italia competente per il territorio di rilascio del documento. La traduzione di certificati rilasciati da altri Paesi potrà essere dichiarata conforme dal Consolato competente per Paese di rilascio oppure essere riconosciuta tramite Apostille.
Certificati Penali del Paese di origine, degli eventuali Paesi terzi di residenza (a partire dai 14 anni d’età) – tranne l’Italia – e dei Paesi di cui si possiede la cittadinanza, in originale, rilasciati inderogabilmente da non oltre sei mesi prima della presentazione della domanda, debitamente legalizzati/apostillati e tradotti in lingua italiana.
Il richiedente è esonerato dal presentare il certificato penale del Paese di origine solo se lo ha lasciato prima del compimento dei 14 anni e non ne ha conservato la cittadinanza.
Per il Canada è richiesto un certificato penale con foto e impronte digitali. Per la richiesta del certificato penale in Canada, si può consultare questo sito e contattare la stazione di polizia locale. Per la legalizzazione del certificato penale rilasciato in Canada, si prega di consultare questo sito: Affaires mondiales Canada, Section des services de l’authentification – JLAC/ Global Affairs Canada, JLAC- Authentication Services Section. Il certificato penale può essere inviato per posta ad Affaires mondiales Canada, Section des services de l’authentification – JLAC / Global Affairs Canada, JLAC- Authentication Services Section che si occuperà della legalizzazione (indirizzo: Global Affairs Canada, Authentication Services Section (JLAC), 2421 Lancaster Road, Ottawa, ON K1B 4L5, Canada).
La traduzione dei certificati penali formati in Canada può essere effettuata da un traduttore o traduttrice certificato/a la cui firma dovrà essere legalizzata dal nostro Consolato Generale (un elenco è disponibile a questo link).
Per i certificati penali di altri Paesi, andrà contattata l’Ambasciata o l’Ufficio consolare competente per il territorio di rilascio del documento. La traduzione di certificati rilasciati da altri Paesi potrà essere dichiarata conforme dal Consolato competente per Paese di rilascio oppure essere riconosciuta tramite Apostille.
Ricevuta del versamento del contributo di 250€ a favore del Ministero dell’Interno e della marca da bollo da 16€, con le modalità indicate nella sezione “Costi”.
Documento di identità: fotocopia del passaporto oppure della carta di identità estera in corso di validità (pagine con i dati personali, fotografia, date di rilascio e scadenza).
Copia dell’atto di matrimonio o estratto per riassunto del registro dei matrimoni, da richiedere al competente Comune italiano in cui l’atto risulta trascritto, possibilmente rilasciato da non oltre sei mesi.
NOTA BENE: Qualora il richiedente sia un cittadino UE, potrà avvalersi dell’autocertificazione ai sensi del DPR 445/2000.

Non sono, invece, tenuti alla presentazione del titolo di conoscenza della lingua italiana:
Gli stranieri (anche se residenti all’estero) che abbiano sottoscritto l’Accordo di integrazione di cui all’art. 4 bis del D.Lgs. n. 286/1998 Testo Unico Immigrazione.
I titolari di permesso di soggiorno per soggiornanti di lungo periodo UE (o CE) di cui all’articolo 9 del medesimo Testo Unico (anche se residenti all’estero), solo se rilasciato dalle Autorità italiane. I permessi di soggiorno per motivi familiari o quelli emessi da altri Stati non sono idonei.
Coloro che hanno conseguito un titolo di studio emesso da un istituto di istruzione pubblico o paritario riconosciuto dal Ministero dell’Istruzione, dell’Università e della Ricerca e/o dal Ministero degli Affari Esteri e della Cooperazione internazionale.
4. Procedura
FASE 1 – REGISTRAZIONE E INSERIMENTO ISTANZA
Il richiedente residente all’estero dovrà effettuare la registrazione sul portale del Ministero dell’Interno (https://portaleservizi.dlci.interno.it/AliCittadinanza/ali/home.htm) senza l’utilizzo di SPID ma con il proprio indirizzo e-mail.
Si precisa che l’indirizzo e-mail dichiarato sul portale in fase di inoltro della domanda online costituisce domicilio eletto (art. 47 c.c.), si rende pertanto necessaria una frequente consultazione della propria casella di posta elettronica in quanto tutte le comunicazioni relative alla domanda di cittadinanza, ivi comprese richieste di integrazione documentale, convocazioni, notifiche di provvedimenti, ecc. avverranno unicamente tramite canale informatico.
Il richiedente è tenuto a registrare i propri dati con la massima attenzione in quanto questi non potranno essere modificati e, in caso di errore, si dovrà procedere ad una nuova registrazione con altro indirizzo e-mail. In particolare, andranno riportate le generalità indicate nell’atto di nascita (incluse eventuali annotazioni) e/o in atti e documenti formati all’estero dalle competenti autorità straniere (quali atti di matrimonio, documenti d’identità, sentenze di cambio nome/cognome, etc.). In caso di discordanze, il richiedente è tenuto a fornire opportuna documentazione giustificativa.
Nella domanda dovrà essere dichiarata l’eventuale convivenza di figli minori del/della richiedente, nati da una precedente relazione.
Si dovranno dichiarare tutte le residenze dal quattordicesimo anno e non lasciare periodi di tempo non dichiarati.
Non andranno riportati caratteri o segni speciali (per esempio la cediglia, accenti acuti o gravi all’interno della parola, accenti circonflessi, etc.). Sarà possibile inserire solo l’accento sull’ultima lettera utilizzando l’apostrofo, qualora ci sia anche nella lingua di origine.
FASE 2 – VERIFICA CONSOLARE
L’Ufficio Consolare sarà automaticamente informato della presentazione della domanda e procederà alle necessarie verifiche. Il richiedente riceverà quindi, in modalità telematica tramite il portale del Ministero dell’Interno, una comunicazione relativa all’accettazione o al rifiuto della propria pratica.
In caso di rifiuto della domanda, si potrà ripresentare la domanda avendo cura di sanare gli errori indicati nel rifiuto stesso e si potranno riutilizzare i pagamenti già effettuati, se si ripresenta la domanda entro un anno.
In caso di accettazione, il richiedente sarà convocato per via telematica presso la Rappresentanza diplomatico-consolare per l’autentica della firma apposta sulla domanda di cittadinanza, per la consegna di tutta la documentazione cartacea in originale, ivi compresa quella già trasmessa per via telematica tramite il Portale, per la riscossione delle percezioni consolari previste.
Tutta la documentazione di cui sopra sarà conservata in originale dalla Rappresentanza diplomatico-consolare, ad eccezione del documento d’identità e del certificato linguistico, per i quali verrà effettuata una copia conforme con relativi pagamenti.
FASE 3 – VALUTAZIONE E TERMINI DEL PROCEDIMENTO
La valutazione della domanda e la definizione del procedimento sono di esclusiva competenza del Ministero dell’Interno, entro 24 mesi dalla data di presentazione della domanda, prorogabili fino al massimo di 36 mesi. Qualora al termine della valutazione della pratica il procedimento si concluda positivamente, il Ministero dell’Interno invierà il decreto di conferimento della cittadinanza italiana alla Rappresentanza diplomatico-consolare competente per residenza dell’interessato/a.
FASE 4 – DECRETO, NOTIFICA E GIURAMENTO
Il decreto di conferimento della cittadinanza italiana verrà notificato – tramite portale – con comunicazione indirizzata al richiedente. All’atto della notifica verranno altresì richiesti documenti volti a verificare la permanenza del vincolo coniugale, con data successiva al decreto, quali, ad esempio (elenco non esaustivo):
Atto integrale di matrimonio rilasciato dal competente Comune italiano (non l’estratto) e corrispondente atto estero
Certificato penale del Paese di attuale residenza, debitamente legalizzato e tradotto (vedi sezione “Documenti”)
Alla data di adozione del decreto, quindi, non deve essere intervenuto lo scioglimento del matrimonio o dell’unione civile né la separazione personale (sentenza di separazione). Invece, il decesso del coniuge avvenuto dopo la presentazione della domanda di cittadinanza non comporta la decadenza del beneficio.
Entro e non oltre sei mesi dalla notifica, l’interessato verrà convocato presso gli uffici consolari, per prestare giuramento di fedeltà alla Repubblica e alle sue leggi. Il termine di sei mesi è tassativo, decorso il quale si perderà il diritto al conseguimento della cittadinanza.
È previsto il pagamento della marca da bollo sul decreto.
L’atto integrale di matrimonio va richiesto al Comune italiano nei cui registri l’atto risulta trascritto; il certificato penale si richiede alle Autorità competenti nel paese di residenza e dovrà essere in regola con le disposizioni in materia di legalizzazione/apostille e traduzione, come spiegato nella sezione “Documenti”.
La persona interessata presterà giuramento di fedeltà alla Repubblica italiana pronunciando le seguenti parole:
“GIURO DI ESSERE FEDELE ALLA REPUBBLICA E DI OSSERVARE LA COSTITUZIONE E LE LEGGI DELLO STATO”
L’acquisto della cittadinanza italiana decorrerà dal giorno successivo a quello del giuramento.
Il certificato di nascita originale sarà inviato per la trascrizione al Comune italiano di riferimento insieme alla richiesta di iscrizione all’AIRE e al verbale dell’avvenuto giuramento.

Acquisition of Citizenship by “benefit of law” (minor children born abroad)
A minor born abroad to Italian parents is considered an Italian citizen without the requirement of a “declaration of intent” only if at least one of the following conditions is met (it will be necessary, nonetheless, to apply for the registration of their birth certificate following the procedure described at this link: Birth – Consolato Generale d’Italia di Montreal):
At the time of birth, the minor can exclusively acquire Italian citizenship, meaning they cannot hold or acquire any other citizenship, such as through ius sanguinis, ius soli, citizenship by option, etc.
At the time of the minor’s birth, a first or second-degree ancestor (parents/grandparents) holds (or held, at the time of their death) exclusively Italian citizenship.
The Italian parent has resided in Italy for at least 2 continuous years after acquiring Italian citizenship and before the birth of the child.
If none of the conditions listed from 1 to 3 apply, the minor born abroad to Italian parents may still acquire Italian citizenship with a declaration of intent from the parents. In this regard, please read the information below carefully.
Acquisition of Citizenship by “benefit of law” (minor children born abroad)
In two cases, provided for by paragraph 1-bis of Article 4 of Law No. 91/1992 and Article 1, paragraph 1-ter of Legislative Decree No. 36/2025, minor children born abroad to a citizen parent who does not “automatically” transmit citizenship may acquire Italian citizenship.
The minor who benefits from this will not be a citizen by birth or iure sanguinis.
According to Article 15 of Law No. 91/1992, the minor does not acquire citizenship from the day of birth, but from the day after the conditions provided for by law are met.
A) In the first case (paragraph 1-bis of article 4 of law no. 91/1992) the following conditions must be jointly possessed:
one of the parents, even if he or she has another citizenship, is an Italian citizen by birth. Therefore, cases of citizens by naturalization pursuant to Article 9 of Law No. 91/1992 or “by benefit of the law” pursuant to Article 4 of Law No. 91/1992 or by marriage pursuant to Article 5 of Law No. 91/1992 or Article 10 of Law No. 555/1912 or by reacquisition pursuant to Articles 13 or 17 of Law No. 91/1992 or iuris communicatione (Article 14 of Law No. 91/1992) are excluded;
both parents (including the foreign parent) or the guardian submit a declaration of intent to acquire citizenship within one year of the birth (or from the subsequent date on which filiation from an Italian citizen is established or on which adoption by an Italian citizen is decided during the child’s minority). In the event of recognition of filiation at a later date by parents who are both Italian citizens by birth, the one-year term will run from the first recognition (because the first recognition already entails the transmission of citizenship). If, however, recognition by a foreign parent (or an Italian citizen not by birth but by another title) occurs first, the one-year term will be calculated starting from the recognition by the second parent who is a citizen by birth.
The declaration of intent to acquire citizenship must be formal and made in person, in the presence of Consular staff delegated to exercise civil registry functions, by appointment to be requested at montreal.cittadinanza@esteri.it
If the parents do not make the declaration at the same time, the legal requirement is considered satisfied on the date on which the declaration of the second parent is submitted.
If the filiation (including adoptive) is established with respect to a single person (or if the other parent is deceased), the declaration of a single parent will be sufficient. In the case of establishment of legal residence of the minor in Italy, the declaration can also be submitted after the end of one year from birth, but the residence must last for at least two consecutive years after the declaration of intent to acquire citizenship submitted by the parents.
B) The second case (paragraph 1-ter of article 1 of Legislative Decree no. 36/2025) applies when all of the following conditions exist:
minors on the date of entry into force of conversion law no. 74/2025, i.e. persons who had not reached the age of 18 on 24 May 2025;
children of citizens by birth who are in the conditions set out in letters a), a-bis) and b) of Article 3-bis of Law No. 91/1992. In other words, the parents must be recognized as citizens on the basis of an administrative or judicial application submitted by 11.59 pm (Rome time) on March 27, 2025 or on the basis of an application submitted on the basis of an appointment communicated by the Consular Office or the Municipality by the same date;
the declaration of the parents or guardian must be submitted to the Consular Office by 31 May 2026. If the interested party, a minor on 24 May 2025, becomes an adult in the meantime, the declaration must be submitted by him personally within the same deadline.
The declarations must be made in person at the Consular Office, in front of consular staff delegated to Civil Registry functions, by appointment to be requested at montreal.cittadinanza@esteri.it
It will also be necessary to attach an identity document of the applicant and the child, proof of residence in the consular district, in addition to the documentation listed in the relevant declaration form.
For Italian citizens registered with AIRE in the consular district of residence, the certificate of Italian citizenship by birth of the father or mother may be replaced by a declaration in lieu of certification.
According to article 9-bis of law no. 91/1992, the payment of the contribution in favour of the Ministry of the Interior of 250 euros applies, for each minor, by wire transfer, with any bank fees to be borne by the person arranging the transfer:

The interested party, once he or she has become an adult, may renounce Italian citizenship acquired in the ways indicated above, with the sole condition that this does not result in a statelessness condition (the interested party may renounce Italian citizenship only if he or she has another citizenship).
Acquisition of Citizenship of minor children living with non citizen parent since birth
Article 14 of Law No. 91/1992, as amended by Decree-Law No. 36/2025 as converted by Law No. 74/2025, stipulates that in order to acquire citizenship in this manner, the child of Italian citizens not from birth must have been legally resident in Italy for at least two continuous years at the time of the parent’s acquisition or reacquisition of Italian citizenship (if the child is less than two years old, he or she must have been resident in Italy since birth).
It is specified that:
In the event that the practice for the recognition of citizenship iure communicatione falls, due to the way it is presented, within the exceptions identified in letters a), a-bis) or b) of Article 3-bis of Law No. 91/1992 (i.e., application – administrative or judicial – presented by March 27, 2025, or application presented at the appointment indicated by March 27, 2025), the previous discipline will apply.
If the application for recognition of citizenship iure communicatione was filed on or after March 28, 2025, it is necessary that the parent transmitting the citizenship be exclusively an Italian citizen or have resided in Italy for two years prior to the birth of the child.
if the parent’s acquisition or reacquisition of citizenship occurs on or after May 24, 2025, the child cohabiting with the parent acquiring or reacquiring Italian citizenship must have been resident in Italy for at least two years prior to the parent’s naturalization. In this case, the competence of ascertaining the acquisition of citizenship by the child will be the responsibility of the Italian municipality of residence.
Reacquisition of the Italian citizenship
Conversion Law No. 74/2025 of Decree Law No. 36/2025 amended Article 17, Paragraph 1, of Law No. 91/1992, allowing former citizens residing abroad, in specific cases and for a limited period of time, to reacquire Italian citizenship by personally signing a declaration before the competent consular officials.
EFFECTS OF REACQUISITION
The declaration of reacquisition has no retroactive effect: the former citizen reacquires Italian citizenship from the NEXT day after signing the declaration.
TRANSMISSION OF CITIZENSHIP TO DESCENDENTS
With the entry into force of the new legislation, the reacquisition of citizenship DOES NOT allow the automatic acquisition of citizenship by children, even in case they are minors (obviously this applies to adults as well) and living with the parents, if they reside abroad.
LIMITED TEMPORAL WINDOW FOR REACQUISITION
The declaration of reacquisition by the former citizen must be submitted, together with the necessary documentation, between July 1, 2025 and December 31, 2027.

the person must have been born in Italy OR, if born outside Italy, must have been resident in Italy for at least two continuous years;
the person lost his/her citizenship before August 16, 1992.

Marriage certificates issued by religious authorities cannot be considered.

b) as an alternative to both the aforementioned certificates, a “Search of Citizenship Records” or an “Access to information” can be submitted.
